The latest guidance concerning single-sex facilities has been acknowledged by the women and equalities minister as a necessary step, despite potential disagreements. Bridget Phillipson highlighted the ongoing debate surrounding the issue, emphasizing that controversies were inevitable with or without the updated regulations.
During her appearance before the Women and Equalities committee, Phillipson emphasized the importance of balancing the rights of women and transgender individuals, acknowledging the increasingly contentious nature of the broader dialogue on the topic.
The minister’s appearance marked her first since the release of the revised guidance by the Equality and Human Rights Commission (EHRC) on single-sex spaces. The updated regulations clarified that access to single-sex services must be based on biological sex according to the Equality Act, aligning with a Supreme Court ruling from 2025.
This means that facilities like single-sex toilets, changing rooms, hospital wards, and refuges must be accessed in accordance with a person’s biological sex, rather than their gender identity.
Phillipson expressed confidence in the clarity provided by the new regulations for service providers such as gyms, leisure centers, and cafes. She acknowledged that while the code might not satisfy all parties, she believed it struck the right balance and was thus presented on behalf of the Government.
