Two teenagers who initially avoided jail time for rape have now been sentenced to four years in detention following a reevaluation by the Court of Appeal. The boys, referred to as X and Y, were initially given youth rehabilitation orders and placed on a supervision program after being found guilty of raping two girls in separate incidents in Fordingbridge, Hampshire.

Another boy, known as Z, also received a youth rehabilitation order for his involvement in one of the attacks and an indecent images offense. The boys had shared videos of the assaults on social media, exacerbating the severity of the situation.

The Court of Appeal’s decision to lock up the two older boys came after their cases were reviewed by the Attorney General under the Unduly Lenient Sentence scheme. In her ruling, Lady Chief Justice Baroness Carr emphasized the gravity of the boys’ actions, stating that their behavior warranted detention for four years due to the harm inflicted on the victims.

Baroness Carr highlighted that the third boy’s lesser involvement and young age influenced the court’s decision not to alter his sentence. The judges took into account the vulnerability of the victims and the psychological impact of the crimes, which the original sentencing judge had allegedly overlooked.

During the appeal hearing, arguments were presented questioning the adequacy of the initial sentencing, with the victims expressing the profound emotional and psychological toll of the assaults. The boys, who were convicted of multiple rape and indecent image offenses, had their sentences reviewed to ensure appropriate punishment and justice for the victims.

The legal representatives of the boys defended the original sentences, asserting that they provided opportunities for rehabilitation and future prevention of similar offenses. Despite the differing opinions on the adequacy of the sentences, the Court of Appeal ultimately decided to impose a four-year detention on the two older boys for their actions.
