A man has been sentenced to nine years in prison for fatally shaking his three-month-old son, Leon Stark, following an incident where he was caught on CCTV hitting the baby’s head at a KFC branch. Gareth Stark, 38, pleaded guilty to charges of battery and manslaughter at Birmingham Crown Court. The baby passed away at Birmingham Children’s Hospital after sustaining severe injuries, including brain damage from abusive head trauma.

Prosecutor Lisa Hancox presented evidence showing Stark’s violent actions towards Leon, with CCTV footage capturing him hitting the infant at the fast-food restaurant. Despite Stark’s claim that he shook the baby in frustration when he wouldn’t stop crying, the court acknowledged the severity of his actions.

Stark’s defense lawyer, Justin Jarmola, highlighted his client’s history of mental illness and expressed Stark’s deep remorse and apology to Leon’s family. In a victim impact statement, Leon’s mother, Lauren Willey, described the devastation caused by the loss of her son and the betrayal she felt from Stark’s actions.

James Leslie Francis from the Crown Prosecution Service emphasized the trust that Stark breached as a father and the severe consequences of his actions. The prosecution emphasized the importance of holding perpetrators of child abuse accountable and ensuring justice for victims like Leon.

The court’s decision to sentence Stark was aimed at providing some closure and justice for Leon’s family during this difficult time.
