The family of a three-year-old boy who tragically lost his life in a playground mishap has initiated legal action seeking compensation for emotional distress.
Kaleb Ortega sustained fatal injuries on April 1 at Rooks Park in Walla Walla, near the Oregon border, when a structure struck him. The lawsuit alleges that the monument collapsed suddenly, resulting in Kaleb being crushed. He was swiftly taken to the hospital, where his mother, a nurse, was present. Unfortunately, he passed away at the medical facility.
His grieving parents, Claudia and Miguel Garcia, have sued multiple companies involved in constructing the monument, claiming it was not adequately safe. Rooks Park, the site of the incident, is a public recreational area in Walla Walla County managed by the US Army Corps of Engineers. It honored Captain Albert H. Rooks and the USS Houston CA-30.
Following Kaleb’s tragic death, the park was closed for two weeks to prevent similar incidents and out of respect for those affected. A GoFundMe page set up for the family recounted the unexpected turn of events on April 1, emphasizing the profound loss felt by all.
Described as a lively and joyful child, Kaleb was cherished for bringing life and laughter to every moment, especially when playing with his older sister. The family lawsuit, filed in Walla Walla County Superior Court, names several defendants, alleging negligence in the monument’s design or lack of appropriate warnings.
The family is seeking emotional damages for the distress experienced by Kaleb’s father, sister, and mother. The defendants are yet to respond to the lawsuit.
