A man who fell victim to a severe miscarriage of justice in the UK is facing a significant loss in compensation due to having to cover the expenses for his own damage assessment. Andrew Malkinson criticized the system, labeling it as “vindictive” and “penny-pinching”, as he found himself burdened with a potential bill of £10,000.

Malkinson, who spent 17 years in prison for a wrongful rape conviction, expressed his frustration at having to bear the costs of his damages assessment and legal fees. He questioned the fairness of the situation, highlighting the financial strain it imposed on him. He called upon the Secretary of State for Justice, suggesting a simple resolution to the issue by government intervention.

Following numerous unsuccessful attempts to challenge his conviction, Malkinson’s case was eventually overturned in 2023 after new evidence pointed to the true perpetrator, identified as Paul Quinn. Quinn, from Exeter, Devon, was found guilty of multiple serious charges and is awaiting sentencing.

Malkinson, now 60, constantly maintained his innocence throughout the ordeal, which began with his identification at a police lineup. The real perpetrator, Quinn, carried out a violent assault on a woman, leading to Malkinson’s wrongful imprisonment.

Further scrutiny is now being directed at Greater Manchester Police for their failure to investigate Quinn earlier, despite his proximity to the crime scene and prior convictions. Detectives focused on Malkinson, overlooking crucial evidence that could have led to Quinn’s earlier apprehension.

An inquiry led by a judge is set to delve into the circumstances surrounding Malkinson’s wrongful conviction, shedding light on the systemic failures that allowed the miscarriage of justice to occur.
