A man who fatally attacked a British father-of-two in a parking lot in Australia will evade trial. Royce Mallett, hailing from County Durham, was visiting Albury, New South Wales, in July 2024, when he got stabbed while seated in his car outside the Hume Inn Motel. The attacker, David Summers-Smith, was diagnosed with schizophrenia and was experiencing psychosis during the incident.
Summers-Smith, who pleaded not guilty to the murder due to mental impairment, was found responsible for the Brit’s death by a judge but deemed not criminally accountable. Court proceedings revealed that the two individuals were strangers lodging at the same motel when Summers-Smith approached Mallett’s car window and fatally stabbed him with a knife he had recently purchased.
Describing the act as catastrophic and tragic, Supreme Court justice Dina Yehia mentioned that Summers-Smith had called the police post-attack and confessed to the stabbing. The court learned that the 29-year-old assailant had a history of untreated schizophrenia, substance abuse, ongoing delusions, and a lack of insight into his condition.
Justice Yehia ordered Summers-Smith’s indefinite confinement in a mental health facility, stating that he lacked the capacity to comprehend the wrongfulness of his actions. In a victim impact statement, Mr. Mallett’s partner expressed the emotional and financial burdens caused by his death, emphasizing the void left in their family. Mr. Mallett’s father also shared the profound loss, highlighting the impact on his life and hobbies.
Summers-Smith will undergo monitoring by the Mental Health Review tribunal, which holds the authority to review his detention order if signs of potential recovery emerge.
