The former CEO of Southern Water, Matthew Wright, and three others are facing charges of conspiring to defraud authorities by allegedly manipulating water quality tests to evade penalties. The Environment Agency (EA) and water regulator Ofwat have brought charges against Wright, Philip Barker, Clive Massey, and Mark Gregory for allegedly engaging in a plan to deceive regulators.

Last year, a judge issued a summons against the accused individuals, prompting Wright to challenge the legality of the summons. However, the High Court recently dismissed Wright’s challenge, allowing the legal proceedings to move forward. The case is set to be heard at Medway Magistrates’ Court on July 14.

The four individuals are accused of conspiring between 2012 and 2017 to deceive public authorities overseeing environmental and financial regulations at Southern Water. Additionally, Southern Water itself faces multiple charges of breaching environmental permit conditions between 2013 and 2017 at various wastewater treatment facilities.

In a tightening of regulations, operators of wastewater treatment works must adhere to strict monitoring protocols to ensure compliance with permit conditions. The accused individuals are alleged to have orchestrated artificial no-flow events to manipulate test results and avoid penalties.

The court proceedings reveal that Terry Stephens, David James, and Mark Butler are also facing charges related to failing to comply with environmental permit conditions. The allegations suggest a deliberate attempt to circumvent regulations for financial gain, potentially leading to significant penalties.

The legal battle surrounding these charges underscores the importance of upholding environmental standards and prosecuting those who seek to deceive regulatory bodies for personal or corporate benefit. The Environment Agency has emphasized its commitment to prosecuting environmental offenders to safeguard public and environmental health.
