“Widow’s Battle: Lack of Power of Attorney Challenges Care Decisions”

Dorothy Cook dedicated herself to caring for her spouse, Melvin, for nearly five decades after he was diagnosed with a rare brain condition. However, her ability to make decisions for him was challenged when a doctor declined to release him from the hospital due to her lack of power of attorney.

Power of attorney is a legal instrument that authorizes a trusted individual to make financial, property, or health choices on behalf of another person. Dorothy, a 68-year-old from Bristol, transitioned from a successful career as an occupational psychologist to being a full-time caregiver for Melvin, who suffered from ataxia, a progressive brain disorder affecting movement and communication.

During Melvin’s hospital stay in March 2025, a medical professional deemed him incapable of making decisions. Dorothy explained that this judgment was influenced by Melvin’s communication difficulties rather than his mental capacity, further complicated by her absence during the evaluation.

Despite already caring for Melvin for years, Dorothy had to demonstrate her ability to continue providing care for him before he could be discharged. Failure to prove her capabilities would have allowed the hospital team to supersede her decisions.

Melvin, a former successful engineer involved in Concorde’s development, began displaying ataxia symptoms 17 years prior, prompting Dorothy to leave her job and devote herself to his care. Melvin passed away at the age of 78 in June 2025, prompting Dorothy to advocate for power of attorney awareness on the inaugural UK-wide Power of Attorney Day.

Reflecting on her experience, Dorothy shared, “The demands of Melvin’s care overshadowed the need for power of attorney. I never want anyone to endure what we did, as it was heartbreaking and added stress to an already challenging situation.” Following Melvin’s discharge, Dorothy established power of attorney and encourages others to take similar proactive steps, emphasizing personal involvement over hiring legal assistance.

Carers UK and Standard Life have partnered to launch the first nationwide Power of Attorney Day, highlighting that only a small fraction of adults have an updated power of attorney in place. Despite the importance of this legal document, less than half of individuals prioritize establishing it, even as they age.

Helen Walker, Chief Executive of Carers UK, stressed the unpredictability of life and emphasized the significance of setting up power of attorney early on to honor individuals’ wishes and alleviate stress and uncertainty for both carers and their loved ones.

Claire Hawkins, Director of Corporate Affairs and Brand at Standard Life, emphasized the necessity of power of attorney as more than a formality, asserting its critical role in safeguarding individuals’ financial management in unforeseen circumstances. Without a power of attorney in place, families may face prolonged legal procedures during crises, hindering access to essential resources and support.
